  • EU Directive 2002/58/EC - It's nearly here, are you ready?

We make no apologies for dominating our latest newsletter with this subject, as it is the biggest change in legislation to effect companies, organisations and individuals operating within the EU. With the above EU Directive set to become Law on 31st October 2003, you should have plans in place to ensure that your web presence complies. 

This directive effects e-business particularly in the areas of unsolicited communications i.e. Opt-In email, SMS for direct marketing purposes and privacy statements.

With regards to unsolicited communications, the use of e-mail and SMS for direct marketing purposes will only be allowed on an opt-in basis (i.e. with the recipients permission). However the directive will allow marketing e-mails concerning a business' own products and services which are similar to those purchased by the recipients in the past, provided that customers are given the opportunity to opt-out of such emails when their data is collected and on the occasion of each message. Common practice such as sending marketing emails on behalf of business partners and list selling will breech the new directive unless the e-mail addresses of the recipients belong to individuals who have previously consented to all types of e-mail marketing.  

Luckily for ebusinesses, the EU Council has softened its approach on the issue of cookies, web bugs, hidden identifiers and similar devices will be allowed provided that the individuals concerned receive clear and comprehensive information (but not necessarily in advance) about the use of that type of technology and are offered the right to refuse it.

Practical Guidance - The following considerations will need to be addressed online:

1) Encryption and access controls are implemented appropriately.

2) Privacy policies are reviewed to ensure that the use of cookies is properly explained.

3) Marketing Opt-In boxes are built into registration forms.

4) Placing Links to privacy policies on order forms referring to the right to Opt-Out of receiving information about similar services.

5) Including Opt-Out mechanisms in every single marketing e-mail.

6) Ensuring that consent is positively obtained if third party products or services are to be advertised by e-mail.

7) Warranties and indemnities are required regarding all recipients' permission to receive unsolicited direct marketing when purchasing e-mail addresses for that purpose.

We are pleased to advise that most of the above has been implemented where applicable as best practice with the projects we have been involved with, but we are continuing to contact our clients where these recommendations still need to be addressed.

  • IT/Internet legal issues - EU Directive 2002/58/EC in detail

It has taken nearly two years for the politicians and lawmakers of the European Union to reach a compromise on how to provide an appropriate level of privacy protection for Internet users. 

With recent research indicating that more than half of UK ecommerce sites do not comply with all of the three main laws covering web sales - the Ecommerce Directive, the Data Protection Act and Distance Selling Regulations!

The survey, commissioned by online legal specialist Clickdocs, says 68% of sites claim to meet data protection rules, but only 18% are registered with the Information Commission. Nearly half of sites do not have a privacy statement, and just 37% comply with Distance Selling Regulations.

Good protection is achieved by having a security policy, which incorporates regular Operating System updates, deploying Anti Virus software and installing a Firewall.
